1. Acceptance of Terms
By accessing or using Liminal Desk ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. These terms apply to all users, including death doula practitioners who manage client records through the Platform.
2. Description of Service
Liminal Desk is a practice management platform designed for end-of-life doulas. The Platform provides tools for client management, session logging, scheduling, invoicing, document management, and care coordination. The Platform is a practice management tool and does not provide medical, legal, or financial advice.
3. User Accounts
- You must provide accurate and complete registration information.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must immediately notify us of any unauthorized use of your account.
- One account per practitioner. Account sharing is prohibited.
- You must be at least 18 years old to use the Platform.
4. Client Data & Privacy
- You retain ownership of all client data you enter into the Platform.
- You are responsible for obtaining proper consent from clients before entering their information.
- The Platform stores data using industry-standard encryption and security measures.
- We will not sell, share, or disclose your client data to third parties except as required by law.

5. HIPAA Considerations
While Liminal Desk implements security measures consistent with HIPAA standards (encryption, access controls, audit logging, session timeouts), the Platform is designed for death doula practitioners who are typically not HIPAA-covered entities. If you are a HIPAA-covered entity, you are responsible for ensuring your use of the Platform meets your compliance obligations. Contact us to discuss a Business Associate Agreement (BAA) if required.
6. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose.
- Store data unrelated to end-of-life care practice management.
- Attempt to access other users' accounts or data.
- Reverse engineer, decompile, or disassemble any part of the Platform.
- Introduce malicious code, viruses, or other harmful technology.
- Share client portal links with unauthorized individuals.
7. Digital Signatures
The Platform provides digital signature capabilities for client service agreements. These signatures are designed to comply with the ESIGN Act and UETA. By using the digital signature feature, you acknowledge that:
- Digital signatures carry the same legal weight as handwritten signatures.
- Signature events are logged with timestamps, IP addresses, and user agent information for audit purposes.
- You are responsible for ensuring clients understand and consent to the digital signature process.
8. Invoicing & Payments
The Platform facilitates invoice creation and tracking. Liminal Desk does not process payments directly. You are responsible for:
- Ensuring invoice accuracy and compliance with local tax regulations.
- Collecting payments through your own payment methods.
- Maintaining accurate financial records as required by law.
9. Data Retention & Deletion
- Your data is retained for as long as your account is active.
- You may export your data at any time using the Platform's export features.
- Upon account deletion, all associated data will be permanently removed within 30 days.
- Signature audit logs may be retained for legal compliance purposes.
10. Limitation of Liability
Liminal Desk is provided "as is" without warranties of any kind. We are not liable for:
- Any decisions made based on information stored in or generated by the Platform.
- Loss of data due to circumstances beyond our reasonable control.
- Interruptions in service availability.
- The DWDA Timeline feature is an organizational aid and does not constitute legal advice regarding Death with Dignity Act compliance.
11. Modifications to Terms
We reserve the right to modify these terms at any time. Material changes will be communicated via email or in-app notification. Continued use after changes constitutes acceptance of modified terms.
